Public offer for online training and sale of goods
Draft for review and preparation for publicationEditorial note. This is a working draft prepared based on the provided company details and the published version of the offer. Before publishing it on the website, information about delivery and the characteristics of specific goods and programs must be completed, the applicable tax regime and local requirements in the countries of sale must be verified, and this note and the following checklist must then be removed. A Russian-language version of the document alone does not replace any locally required pre-contractual consumer disclosures.
- Each product page must separately state the price in KGS and USD, the currency actually charged, applicable taxes, contents, language, duration, and procedure for providing the service.
- For physical goods, specify the countries available for delivery, carrier, delivery time, cost, return address, return conditions, and how customs duties are disclosed. Orders must not be accepted for countries where delivery has not actually been set up.
- For in-person classes, specify the date, country, city, address, language, included expenses, and rescheduling conditions. The Moscow address from the previous offer has not been included in this draft.
- Verify the seller’s legal name throughout the website. Different seller details currently appear in published sections. The offer, footer, checkout page, privacy policy, and refund policy must all use the same current legal details.
- Clarify invoicing/receipt procedures, taxes, and electronic payment rules in Kyrgyzstan and in the countries where sales will be offered. For Turkey, prepare the required pre-contractual disclosures and localized terms.
- Review each consent checkbox used during checkout: acceptance of the offer must be separate; consent to marketing communications must be separate; and consent to immediate commencement of performance must be obtained separately where required by law. These boxes must not be pre-checked.
Square brackets in the contractual text indicate information that must be completed or verified before publication. Remove the brackets once the information has been finalized.
PUBLIC OFFER
for the provision of educational and informational services and the sale of goods
Version dated [publication date] • Order currencies: Kyrgyzstani som (KGS) and U.S. dollar (USD)
1. General terms
1.1. Individual Entrepreneur Petchenko Mariya Alekseevna, registered in the Kyrgyz Republic (hereinafter referred to as the “Service Provider” or “Seller”), offers any legally competent individual, as well as any legal entity or individual entrepreneur, the opportunity to enter into an agreement under the terms of this public offer (hereinafter referred to as the “Offer”). A buyer purchasing goods or services for personal, family, or household purposes is hereinafter referred to as the “Consumer.”
1.2. This Offer applies to the remote sale of educational programs, online courses, access to educational materials, clubs and other digital products, consulting and related services, as well as physical goods and kits offered on pigment-world.com, pigment.world, or any related checkout page (hereinafter referred to as the “Website”).
1.3. Sales are intended for customers in the Kyrgyz Republic, CIS countries, and Turkey, provided that checkout and the selected payment or delivery method are available for the relevant country. Sales to other countries are permitted only if the country is shown as available during checkout for the specific order. The Service Provider may decline to confirm an order if it cannot lawfully accept payment or fulfill the order in the Buyer’s country.
1.4. The information provided on the page of a specific course, service, or product — including its name, contents, price, currency, language, access period, dates, place of instruction, product characteristics, delivery terms, and other material conditions — forms part of the agreement for that order. If the product page differs from this Offer, the terms of the specific order shall apply to the extent that they clarify the product and do not limit any mandatory rights of the Consumer.
1.5. The relationship between the parties shall be governed by the laws of the Kyrgyz Republic. If mandatory laws of the Consumer’s country of residence grant the Consumer additional rights, those rights shall remain in effect and shall not be limited by the choice of Kyrgyz law. Nothing in this Offer deprives the Consumer of protections that cannot legally be waived.
2. Definitions
2.1. Program means an online course, educational module, club, webinar, practical class, or other educational or informational service described on the Website.
2.2. Digital Material means a video, text, presentation, file, training manual, class recording, assignment, or other material provided electronically.
2.3. Product means a tangible item, including equipment, pigments, consumables, and kits offered for sale on the Website.
2.4. Order means the products selected by the Buyer, their quantity, currency and total amount payable, delivery address or country, and any other parameters shown in the checkout form and order confirmation.
2.5. Personal Account means the Buyer’s account on the educational platform or Website used to access Digital Materials and services. If access is provided through GetCourse, the login link will be sent to the Buyer’s email address.
3. Placing an order and entering into the agreement
3.1. Before placing an order, the Buyer reviews this Offer, the product description, the full price, and the terms under which the product or service will be provided or delivered. Material information is displayed before the order and payment are confirmed.
3.2. To place an order, the Buyer provides accurate contact information, selects the product and currency, reviews the contents of the order, and confirms acceptance of this Offer by checking a separate box where such a checkbox is provided in the checkout form.
3.3. The agreement is deemed entered into after the Service Provider confirms the order and receives payment or the first installment, if installments are expressly offered for the product. Creating an account, submitting an unpaid application, or browsing the Website does not constitute acceptance of this Offer.
3.4. The Service Provider sends an order confirmation and order details to the Buyer’s email address or by another method specified during checkout. The Buyer should retain the confirmation and the terms that applied at the time the order was placed.
3.5. Before payment, the Buyer may review and correct the order information. If an error is discovered after payment, the Buyer must promptly notify the Service Provider using the contact information provided in Section 14.
4. Price and currency
4.1. The price of each product is displayed in Kyrgyzstani som (KGS) and U.S. dollars (USD). The exact amount payable and the transaction currency are fixed in the checkout form before payment is confirmed. The Buyer selects one of the available currencies, and the amount shown in the confirmed order becomes the contractual price.
4.2. If prices in KGS and USD are displayed simultaneously, the Service Provider keeps both values current. The amount shown in the selected currency in the confirmed order takes priority for payment purposes. Russian rubles are not used as a pricing or settlement currency under this Offer.
4.3. The price and any mandatory taxes, fees, delivery charges, and other expenses that must be included in the total price under applicable law are displayed before payment. No additional paid services may be added to the order without the Buyer’s separate consent.
4.4. If the Buyer’s card or bank account is denominated in another currency, conversion is carried out by the bank or payment provider according to its own rules and exchange rate. Fees charged by the Buyer’s bank, correspondent bank, or payment provider are disclosed in advance to the extent that the Service Provider can control or influence them. Exchange rates and third-party bank fees are not set by the Service Provider.
4.5. Payment may be made using any method available at checkout, including through an integrated payment service or by bank transfer to the Service Provider’s KGS or USD account listed in Section 14. An Order is deemed paid once confirmation is received from the payment provider or the funds are credited to the Service Provider’s account. The Buyer must not send card details or banking passwords by email or messenger.
4.6. Installment plans or recurring payments are available only where expressly offered for a specific product and where the payment schedule is shown before the order is placed. The terms of any separate credit agreement entered into with a bank or other lender are governed by the Buyer’s agreement with that party.
5. Provision of online services and Digital Materials
5.1. The contents, format, language, scope, start dates, duration, access period, module release schedule, and level of feedback for each Program are specified in the description of the selected product.
5.2. Unless the product description states otherwise, access to the first module or materials is provided within 24 hours after payment is confirmed. Access information is sent to the Buyer’s email address. Subsequent modules, assignments, feedback, and classes are provided according to the schedule of the selected Program.
5.3. The Buyer is responsible for having a compatible device, software, and internet connection. The Service Provider is not responsible for failures involving the Buyer’s equipment or internet connection but will reasonably assist with platform-related issues that are within the Service Provider’s control.
5.4. An in-person practical module is provided only if it is included in the selected plan. Before the order is placed, the Program page must specify the date or procedure for scheduling the date, country, city, exact address, language, included expenses, safety requirements, and rescheduling rules. Travel, accommodation, meals, visas, and the Buyer’s insurance are not included in the price unless expressly stated otherwise.
5.5. If the selected Program includes assignments, assessment of work, or a completion document, the conditions for obtaining them, the type of document, and the issuance period are specified in the Program description. Such a document does not constitute a government-issued diploma or official qualification unless that status is expressly and lawfully confirmed in the product description.
5.6. The Buyer must not share login credentials, passwords, or personal access links with third parties. The Service Provider may temporarily restrict access where there is evidence of account sharing, unauthorized distribution of materials, or another material threat to the Service Provider’s rights, provided that the Buyer is notified in advance and given an opportunity to remedy the violation where reasonably possible.
6. Sale and delivery of physical goods
6.1. Product characteristics, contents, price, availability, and photographs are provided on the relevant product page. Before payment, the Buyer is informed of delivery availability for the selected address, the applicable carrier or delivery method, estimated delivery time, delivery cost, and available tracking method.
6.2. An order for physical goods is accepted only for countries and addresses available during checkout. If the Website does not show delivery as available to the Buyer’s country, or the delivery price and time have not been confirmed, an order to that address is not considered placed.
6.3. Import duties, taxes, and fees are disclosed before purchase to the extent that they are determined during checkout and must be disclosed by the Service Provider. If applicable law requires such charges to be paid separately by the recipient upon import, this must be clearly disclosed before payment. Such charges may not be added retroactively to the confirmed price except where expressly permitted by applicable law.
6.4. The risk of loss or damage to the Product and transfer of ownership are determined by the applicable law of the Buyer’s country and the agreed delivery method. The Buyer should report any visible damage upon receipt and retain the packaging and carrier documentation, without losing any mandatory rights provided by law.
6.5. If a plan includes a physical kit, its contents and value are stated separately in the order description. Cancellation of the Program and return of the physical kit are handled separately in accordance with the applicable rules for services and goods.
7. Rights and obligations of the parties
7.1. The Service Provider agrees to provide the selected service or Product in the agreed scope, notify the Buyer of material changes, issue payment confirmation, and review inquiries related to the Order.
7.2. The Service Provider may engage instructors, mentors, carriers, educational platforms, and payment providers while remaining responsible to the Buyer for performance of the agreement to the extent required by applicable law.
7.3. The Buyer agrees to provide accurate information, pay for the Order, comply with safety rules during practical training, and use the provided materials only for personal or internal educational purposes unless otherwise agreed in writing.
7.4. Program materials, methods, images, videos, texts, and other content are protected by intellectual property laws. Without written permission, the Buyer may not copy such materials for distribution, sell them, publish them, or provide them or class recordings to third parties. This restriction does not affect the Buyer’s lawful rights or mandatory exceptions provided by applicable law.
7.5. The training is intended to help the Buyer master the contents of the Program but does not in itself guarantee a specific level of income, number of clients, employment, professional licensing, or commercial outcome.
8. Cancellation and refunds
8.1. The Buyer’s rights to cancel the agreement, return goods, and receive refunds are governed by this Section and by any mandatory laws applicable to the specific Order in the relevant country. If mandatory law grants broader rights or establishes a shorter refund period, the applicable mandatory rule shall prevail.
8.2. Consumers in Turkey retain the statutory right to withdraw from a distance contract, generally within 14 days, as well as any other mandatory rights provided by Turkish law. The law provides certain exceptions, including for certain electronically supplied services, digital content, and services whose performance begins immediately with the consumer’s prior consent. Whether an exception applies depends on the specific product and current law. Required withdrawal information and confirmations must be displayed before payment.
8.3. The Buyer may submit a cancellation or refund request to
pigment.world.pmu@gmail.com. The request should preferably include the Buyer’s name, order number, product, and preferred contact method. Failure to provide optional information does not invalidate the Buyer’s right to submit a cancellation notice.
8.4. Unless a mandatory right of withdrawal provides otherwise, the Buyer may cancel a service before it has been fully performed. The refund amount is determined based on the portion of services actually provided by the time of cancellation and the Service Provider’s actual expenses, but only to the extent that applicable law permits such amounts to be retained. Providing a link or opening access alone does not deprive the Consumer of any mandatory cancellation or refund rights.
8.5. For a distance-learning course, the value of the completed portions is calculated using the separately stated prices of modules if those prices were disclosed before payment. If individual module prices were not published, the calculation is made proportionally based on the volume of services actually provided and in accordance with mandatory applicable law. The unprovided portion is refunded within the period required by law.
8.6. Returns of non-defective goods and defective goods are handled according to the rules applicable in the Buyer’s country. Restrictions related to opened packaging, hygienic characteristics, or custom-made products apply only where and to the extent expressly permitted by applicable law.
8.7. Refunds are made using the original payment method where required by applicable law or technically possible. If a refund to the original payment method is not possible, the parties will agree on another lawful method. The refund period will not exceed the period established by mandatory applicable law. If no such period is established, the refund will be made within 10 business days after the refund amount has been confirmed. Bank fees and currency conversion differences are governed by the relevant payment provider’s rules and do not reduce the amount that the Service Provider is legally required to refund.
8.8. If the service cannot be provided due to the fault of the Service Provider or the Order is canceled by the Service Provider, the amount paid for the unprovided portion will be refunded within the period required by applicable law.
9. Technical support and complaints
9.1. For questions relating to access, payment, goods, or delivery, the Buyer may contact the Service Provider using the email address or phone number specified in Section 14. To help speed up the response, the Buyer should provide the order number and describe the issue.
9.2. The Service Provider acknowledges receipt of an inquiry and responds within a reasonable period, generally within 10 business days, unless a different period is required by applicable law. This procedure does not suspend or shorten any mandatory deadlines for filing an application, complaint, or request with a competent authority.
9.3. The Buyer has the right to apply to a court, consumer protection authority, or other competent body available under applicable law. A prior complaint to the Service Provider is not a prerequisite for using such remedies unless otherwise required by law.
10. Personal data and communications
10.1. Personal data is processed for the purposes of placing and fulfilling Orders, communicating with the Buyer, complying with legal requirements, and protecting the rights of the parties. Detailed purposes, retention periods, and processing methods are described in the Personal Data Processing Policy available on the Website at:
https://pigment.world/privacy-policy/.
10.2. Acceptance of this Offer does not replace separate consent to personal data processing where such consent is required by law. Marketing communications are sent only with the Buyer’s separate consent where required by applicable law.
11. Liability and circumstances beyond the parties’ control
11.1. The parties are liable for breaches of their obligations in accordance with applicable law. Nothing in this Offer excludes any liability that cannot legally be limited, including mandatory Consumer rights.
11.2. The Service Provider is not responsible for inability to access services caused by incorrect contact information provided by the Buyer, failure of the Buyer’s device, or third-party networks outside the Service Provider’s reasonable control. The Service Provider will, however, take reasonable steps to restore any access it is responsible for providing.
11.3. A party whose performance becomes impossible due to an extraordinary and unavoidable event beyond its control must notify the other party within a reasonable period and take reasonable measures to mitigate the consequences. If performance becomes permanently impossible, payment for the unprovided portion will be settled in accordance with applicable law.
12. Governing law and dispute resolution
12.1. The parties will seek to resolve disputes through direct communication. The Buyer may submit a complaint to the email address specified in Section 14.
12.2. This Offer is governed by the laws of the Kyrgyz Republic, while preserving any mandatory Consumer rights granted by the law of the Consumer’s habitual country of residence or other laws applicable to distance sales.
12.3. A dispute may be submitted to a competent court or authority in accordance with applicable law. The choice of Kyrgyz law does not deprive the Consumer of the right to apply to a court or authority that has jurisdiction under the mandatory rules of the Consumer’s country of residence.
13. Term and amendments to the Offer
13.1. This Offer is effective from the date it is published on the Website until withdrawn by the Service Provider. The version available to the Buyer at the time the agreement is entered into applies to the relevant Order.
13.2. The Service Provider may publish an updated version of the Offer for future Orders. Amendments do not retroactively worsen the terms of an already concluded agreement and do not limit mandatory Consumer rights.
13.3. If any provision of this Offer is held invalid or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
